  1. Introduction

    1. Welcome to Boycat, a mobile application ("App") operated by Boycat LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of Boycat, available on the Apple App Store and Google Play Store.

  2. Acceptance of Terms

    1. Agreement to Terms: By downloading, accessing, or using Boycat, you agree to be bound by these Terms. This agreement forms a legally binding contract between you and Boycat.

    2. Eligibility: By agreeing to these Terms, you affirm that you are legally competent to enter into this agreement. If you are using the App on behalf of an organization or entity, you represent that you have the authority to bind that organization to these Terms.

    3. Non-Acceptance: If you do not agree with any part of these Terms, you are not authorized to access or use the App.

  3. Changes to Terms

    1. Right to Modify: Boycat reserves the right to modify these Terms at any time. Changes may reflect updates to our services, legal requirements, or other essential aspects.

    2. Notification of Changes: We will notify users of any significant changes by updating the date at the top of these Terms and through in-app notifications or emails, depending on the nature of the change.

    3. Review of Changes: It's important to review any changes to the Terms. Your continued use of Boycat after changes have been made constitutes your acceptance of the revised Terms.

  4. Use of the App

    1. Age Requirement: Boycat is intended for users aged 13 and above. By using Boycat, you represent and warrant that you meet this age requirement and that you are capable of understanding and accepting these Terms.

    2. Appropriate Use: You agree to use Boycat only for lawful purposes and in a way that does not infringe the rights of or restrict or inhibit anyone else's use and enjoyment of the App.

    3. User Accounts: If registration is required for certain features of Boycat, you must provide accurate and current information for your account and promptly update any changes.

    4. Security: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

    5. Restrictions: You must not misuse the App by knowingly introducing viruses, trojans, worms, or other material that is malicious or technologically harmful.

  5. User Accounts

    1. Account Creation: To access certain features of Boycat, users may be required to create an account. During registration, you agree to provide truthful and accurate information.

    2. Account Responsibility: You are responsible for all activities that occur under your account. This includes maintaining the confidentiality of account credentials and promptly notifying us of any unauthorized use or security breach.

    3. Account Updates: You are expected to keep your account information, including contact details, current and accurate.

    4. Account Security: We encourage the use of strong passwords and regular updates to enhance account security.

  6. User Conduct and Liability

    1. Responsible Use: As a user of Boycat, you are expected to use the App responsibly and ethically. This includes respecting the rights and dignity of others.

    2. Prohibited Activities: You must not engage in any activity that is illegal, threatening, defamatory, infringing on intellectual property, invasive of privacy, or otherwise harmful to third parties or objectionable.

    3. User-Generated Content: If the App allows posting content, you are solely responsible for the content you post. You must ensure that your content is not misleading, offensive, or in violation of any laws.

    4. Liability for Conduct: You are liable for your actions while using Boycat. Boycat LLC is not responsible for the actions of users or the consequences of those actions. Users may be held legally accountable for damages or harm caused by their misuse of the App.

  7. Content and Intellectual Property

    1. Ownership of Content: All content in Boycat, including text, graphics, logos, images, and software, is the property of Boycat LLC or its content suppliers and is protected by intellectual property laws.

    2. Usage Restrictions: You agree not to copy, modify, distribute, sell, or lease any part of our App or included content, nor may you reverse engineer or attempt to extract the source code of that software, without our prior written permission.

    3. Respect for Intellectual Property Rights: You should respect the intellectual property rights of others when using Boycat. Infringing on the rights of others may lead to the termination of your account and legal action.

    4. Reporting Infringements: If you believe that your intellectual property rights have been infringed within the App, please contact us so we can address your concerns.

  8. Termination

    1. Grounds for Termination: We may terminate or suspend your access to Boycat if you breach these Terms, engage in prohibited conduct, or for other serious infractions. Termination may be immediate and without prior notice.

    2. Effects of Termination: Upon termination, your right to use Boycat will cease immediately. If your account is terminated, you may lose access to any data or content associated with your account.

    3. Post-Termination Responsibilities: You are still responsible for any obligations incurred prior to termination, including any charges or fees.

  9. Disclaimer of Warranties

    1. "As Is" Basis: Boycat is provided on an "AS IS" and "AS AVAILABLE" basis. Boycat LLC expressly disclaims all warranties, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

    2. No Warranties for Functionality: We do not warrant that Boycat will function uninterrupted, be secure, or be available at any particular time or location.

    3. No Warranties for Content: We make no warranties regarding the accuracy, reliability, or quality of any content, products, services, or information provided through Boycat.

  10. Limitation of Liability

    1. Scope of Liability: To the fullest extent permitted by law, Boycat LLC, its affiliates, and its licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

    2. Cap on Liability: In no event shall the aggregate liability of Boycat LLC exceed the amount you paid us, if any, in the past six months for the services giving rise to the claim.

    3. Jurisdictional Limitations: Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations and exclusions may not apply to you.

  11. Governing Law

    1. Jurisdiction: These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

    2. Legal Compliance: You agree to comply with all local, state, national, and international laws and regulations applicable to your use of Boycat.

    3. Dispute Resolution Location: Any disputes arising from or relating to the Terms or Boycat shall be subject to the exclusive jurisdiction and venue of the courts located in California.

  12. Dispute Resolution

    1. Mandatory Arbitration: In the interest of resolving disputes between you and Boycat LLC in the most expedient and cost-effective manner, you and Boycat LLC agree that any dispute arising out of or in any way related to these Terms or your use of Boycat shall be resolved by binding arbitration.

    2. Arbitration Rules: Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, except as modified by this Dispute Resolution provision.

    3. Arbitration Process: An arbitrator will be chosen in accordance with the rules of the AAA. The arbitrator’s decision will be binding and final, except for a limited right of review under the Federal Arbitration Act.

    4. Waiver of Jury Trial: You and Boycat LLC hereby waive any constitutional and statutory rights to sue in court and receive a trial by jury. The arbitrator will have the authority to grant motions dispositive of all or part of any claim.

    5. Waiver of Class or Consolidated Actions: All arbitrations shall proceed on an individual basis. You and Boycat LLC agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

  13. International Use

    1. Compliance with Local Laws: Boycat may be accessed from countries around the world and may contain references to services and content that are not available in your country. These references do not imply that Boycat LLC intends to announce such services or content in your country.

    2. Responsibility for Compliance: You are responsible for ensuring that your access to and use of Boycat is in compliance with all laws, regulations, and rules applicable in your jurisdiction.

    3. Restrictions on Access: Boycat LLC makes no representation that Boycat is appropriate or available for use in locations outside the United States. Accessing Boycat from territories where its contents are illegal is prohibited.
